## Spain Trademark Watch BOPI | Vigilancia de marcas OEPM

Vigila el BOPI por ti: cuando publican una marca parecida a alguna de tu cartera, te avisa con los días que quedan de los dos meses para oponerte. Compara por sonido, no por letras.

### What it does · Que hace

- **Parecido fonético en castellano** — C/K/QU, B/V, LL/Y, H muda, dobles y seseo. Pilla BALENSIA contra VALENCIA, KASA contra CASA, OYA contra OLLA. Un buscador de texto no las ve.
- **Regla de las marcas cortas**: con 4 letras o menos exige coincidencia exacta, para no llenarte de falsos avisos.
- **El reloj de los dos meses** — cada aviso trae los días que quedan del plazo de oposición, no la fecha a secas.
- **Las 45 clases de Niza** y las familias que compiten entre sí. Una marca idéntica en una clase que no compite contigo no es una amenaza.
- **Avisos de renovación** que vencen.
- **Para agencias y despachos** que llevan 200-500 marcas de terceros y responden ellos si se les pasa un plazo.
- **La OEPM ya avisa gratis** (art. 18.4) y hay que decirlo. Pero solo de lo que detecta su propia búsqueda 'según sus disponibilidades técnicas', a efectos meramente informativos, y el aviso va al representante.
- **La línea roja**: no dice si una oposición va a prosperar ni si dos marcas son legalmente confundibles. Eso es asesoramiento jurídico y lo pone el despacho. Aquí está el porcentaje, la clase y el día — y eso es justo lo que hace que una agencia lo use en vez de verlo como competencia.

Una carpeta de tu ordenador con boletines del BOPI ya descargados, para revisar varios de golpe. Util para ponerte al dia si llevas semanas sin mirar.

## `competidores` (type: `array`):

Si alguno de estos registra una marca nueva, te avisa.

## `consultar_clases` (type: `string`):

Un nombre que estas pensando registrar: te digo en que clases de Niza hay ya marcas parecidas. Sirve para elegir clase antes de pagar la tasa.

## `consultar_nombre` (type: `string`):

Comprueba si un nombre concreto esta libre en el BOPI antes de gastarte el dinero en registrarlo.

## `contacto` (type: `string`):

Tu correo o telefono. Sale al pie del informe, para que quien lo reciba sepa a quien contestar.

## `cookie` (type: `string`):

Solo si la descarga pide sesion.

## `corte` (type: `integer`):

Cuanto tienen que parecerse dos marcas para que te avise, de 0 a 100. Con 70 caza los parecidos de verdad sin llenarte de ruido. Bajalo si quieres hilar mas fino.

## `despacho` (type: `string`):

El nombre de tu despacho o empresa. Sale en la cabecera del informe, para reenviarlo tal cual a tu cliente.

## `euipo_xml` (type: `string`):

Sin esto NO se cubren las marcas de la Union Europea, que tambien protegen en Espana.

## `fecha` (type: `string`):

Para calcular los dias que quedan. Por defecto, hoy.

## `meses_aviso` (type: `integer`):

Con cuantos meses de antelacion te aviso de que una marca tuya caduca. Doce da tiempo de sobra a renovarla sin agobios.

## `pie_correo` (type: `string`):

Un texto tuyo al final del correo: tu firma, un aviso legal o lo que quieras anadir.

## `titular` (type: `string`):

El nombre con el que tienes registradas tus marcas. Sirve para reconocer cuales son tuyas dentro del boletin.

## `xml_pegado` (type: `string`):

El XML de un boletin del BOPI pegado aqui directamente. Para probar el producto sin darme tus claves de la OEPM.

## `xml_url` (type: `string`):

Descarga del portal OpenData de la OEPM. Requiere registro previo gratuito.

## `fecha_boletin` (type: `string`):

La fecha del boletin que me estas dando, en formato DD/MM/AAAA. El XML del BOPI no la lleva dentro, y sin ella no puedo decirte cuantos dias te quedan para oponerte. Si dejo que me lo descargue yo de la OEPM, este campo no hace falta.
