Trademark Search — USPTO Serial Lookup + IP Australia Name Search

Use it for trademark due diligence and brand clearance: profile brand owners and research competitors’ marks — output is company data (mark, owner, status, dates, classes).

This trademark search API returns mark text, owner, status, filing and registration dates, goods + services, Nice classification, prosecution history, design code, and a live/dead flag as clean JSON. Coverage differs by search type — read the Coverage note below. A pay-per-result alternative to TrademarkVision, Corsearch, CompuMark Pro, and LegalZoom's trademark search tool — built for trademark attorneys running clearance searches, brand strategists checking name availability, IP-monitoring firms watching competitor filings, and startup founders verifying brand-name viability before incorporation.

Coverage (read this first)

  • Serial / registration-number lookup → USPTO (US). A lookup by US serial or registration number is served from the official USPTO TSDR source and returns that US record.
  • Brand-name / word-mark search → US register via TMview first, IP Australia top-up. The name-search path queries the US register through the TMview network (paged 30 per request, up to maxResults = 200). If the US register returns fewer rows than you asked for, the IP Australia register tops up the remainder. Each record carries an office field (US / AU) so you always know its jurisdiction.
  • Broadened fallback (default on). If your exact query returns 0 marks and no source was blocked, the actor retries with a broadened query — legal suffixes stripped (Acme Widgets Inc → Acme Widgets), then the most distinctive word (Acme) — and returns those rows labelled match_mode: "broadened" with requested_query / matched_query so nothing is mistaken for an exact hit. Set exactOnly: true to turn this off. Zero-row runs cost nothing beyond the start fee and say why in the run status.

Every actor below is part of the NexGenData Global IP & Trademark Suite, so a clearance, freedom-to-operate, or brand-protection workflow that starts in one office can extend to every office, worldwide.

Most trademark attorneys + brand teams pick this actor instead of LegalZoom's $199-per-search clearance fee because they're running dozens of searches per project — this actor is a drop-in alternative that turns a $5,000 clearance bill into $5, cheaper than Corsearch for screening + early-stage knockout searches, and drop-in JSON for downstream conflict-scoring models.

What You Get Per Mark

Each dataset item is a flat record:

  • serial_number, registration_number
  • mark_text — the literal text element of the mark
  • mark_type — Word / Design / Word+Design / Standard Character
  • status_code, status_description — full TESS status string
  • live_dead — LIVE / DEAD
  • filing_date, registration_date, abandon_date
  • nice_classes[] — international class numbers
  • us_classes[] — US classification
  • goods_services — full text of the description
  • owner — {name, address, country, entity_type}
  • attorney — listed attorney of record
  • correspondent_address
  • prior_registrations[]
  • prosecution_history[] — every event with {date, code, description}
  • design_code[] — for design marks
  • disclaimers[]
  • tess_url — direct link to USPTO TESS record

Use Cases

  • Trademark attorneys — bulk knockout searches before formal clearance; saves 10-20 hours per clearance memo
  • Brand strategists — check 50 candidate names in 5 minutes during a naming workshop
  • IP monitoring firms — daily watch on competitor filings in a tracked Nice class
  • Startup founders — verify name availability before LLC formation or domain purchase
  • M&A diligence teams — pull a target's full TM portfolio in a single run
  • Trademark watch services — feed bulk results into a conflict-scoring model to prioritize attorney review

Quick Start

from apify_client import ApifyClient
client = ApifyClient("YOUR_APIFY_TOKEN")
run = client.actor("nexgendata/uspto-trademark-search").call(run_input={
"query": "Acme Widgets",
"searchType": "name", # or "serial" with query="97126665"
"maxResults": 50,
"exactOnly": False, # default: broaden when the exact query is empty
})
for item in client.dataset(run["defaultDatasetId"]).iterate_items():
print(item["mark"], item["office"], item["status"], item["match_mode"], item["owner"])

Clearing a list of marks? One run instead of one run per mark. Put every name in queries; each gets its own exact-then-broadened search, maxResults applies per name, and every row carries requested_query so you can group the results. (Real run on 2026-09-19: 4 names, 30 rows in 22 seconds — 6OF6Rmouwr8c9YQS5.)

{
"queries": ["nike", "adidas", "puma", "acme widgets"],
"searchType": "name",
"territories": ["US"],
"maxResults": 10
}

Names with no match are listed in the run's status message and cost nothing. queries is for search mode; watch mode still tracks one query per run.

Pricing

Pay-per-event (live prices):

  • apify-default-dataset-item — $0.05 per trademark record returned (about 20 records per $1)
  • apify-actor-start — $0.00005 per run start
  • watch-check — $0.05 once per completed watch-mode run

No subscription, no minimum, no per-seat fee. A run that returns 0 records is charged the start fee only.

How NexGenData Pricing Works

Every NexGenData actor uses pay-per-event pricing — you only pay for results that actually land in your dataset. No monthly minimum, no seat fees, no surprise overage bills.

  • Actor Start: a single-event charge each time you spin the actor up (scaled to memory size)
  • Result / item: charged per item written to the default dataset
  • No charge for retries, internal proxy rotation, or failed sub-requests — those are absorbed by the platform

💰 Pricing Example

This actor uses Pay-Per-Event pricing — you only pay for results.

  • Typical run (small): 100 results × $0.05 = $5.00
  • Medium run: 500 results × $0.05 = $25.00
  • Large run (power user): 2,000 results × $0.05 = $100.00

Free Apify accounts get $5/mo in platform credit. A typical IP intelligence workflow at this scale typically exceeds the free credit — upgrade to a paid Apify plan for unrestricted use.

Run it on a schedule

For brand protection, a weekly run on each mark you watch is enough for most teams, and daily suits active monitoring of a name or a competitor during a launch or dispute. Trademark registers change slowly but steadily: between runs you may see new filings that match your name and status changes on existing marks, such as a mark going from live to dead. Turn on watchMode (and name it with watchLabel) so each scheduled run returns only what is new, and you are billed only for the new records each run returns. Watch mode tracks one query per run, so set up one schedule per mark. Send each run's results onward with a webhook, Google Sheets, Zapier, Make or the Apify API.

FAQ

USPTO's own search and TSDR are free, but they are built for checking one mark at a time in a browser. This actor runs a whole list of names in one go with queries, returns clean JSON or CSV with mark, owner, status, live/dead flag, serial and registration numbers, dates, classes and goods and services, and marks each row with its office. It needs no login or API key, you pay per record, and watch mode turns a search into a scheduled monitor.

What does a typical run cost?

You pay per result, not for run time: $0.05 for each row in the results, plus $0.00005 per run start (charged per GB of run memory, minimum one). A run that returns 20 trademark records costs about $1.00. Optional extras are charged only when you turn them on: a watch-mode change check $0.05. Live prices are always shown in the Pricing tab.

How do I check if a brand name is already trademarked in the US?

Run a name search with searchType set to name, your brand in query, and territories set to ["US"]. The US register is searched through the TMview network first, and if it returns fewer rows than you asked for, the IP Australia register tops up the rest, so check the office field on each row. This is a fast knockout screen before formal clearance, not a clearance opinion.

How do I look up a US trademark by serial number?

Set searchType to serial and put the serial or registration number in query, for example 97126665. The record is served from the USPTO TSDR source and returns that US mark.

What does "broadened" mean in the results?

If your exact query returns no marks, the actor retries with legal suffixes removed and then with the most distinctive word, and labels those rows match_mode: "broadened" with the requested and matched query. Set exactOnly to true to turn this off. Names with no match cost nothing beyond the start fee.

Does it cover EU or other countries' trademarks?

Not today. Coverage is US records plus the IP Australia register. For EU marks, use the EUIPO Trademark Search actor, and for the UK register, the UK Trademark Search actor.
